These Terms and Conditions (“Terms”) govern your access to and use of the Futuresend mobile application (“the App”), operated by Futuresend App, as well as the services provided through the App. By downloading, accessing, or using the App, you agree to comply with these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By using the App, you agree to these Terms and any additional rules or guidelines referenced herein. We reserve the right to modify these Terms at any time, and your continued use of the App following any changes constitutes your acceptance of the new Terms.
2. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You further agree not to:
- Use the App in any manner that violates applicable laws or regulations.
- Interfere with or disrupt the functioning of the App or its servers.
- Attempt to access unauthorized areas of the App.
- Transmit harmful content, including viruses or malware.
3. Account Registration
To access certain features of the App, you may be required to register for an account. You agree to provide accurate and current information, keep your account secure, and notify us immediately of any unauthorized use. You are responsible for all activities that occur under your account.
4. Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your personal data as described in the Privacy Policy.
5. In-App Purchases and Payment
The App may offer paid services or features. If you make a purchase, you agree to provide accurate payment information and abide by the payment terms of the third-party payment processor. All fees are non-refundable unless required by law.
6. Intellectual Property
All content—including trademarks, logos, graphics, and other materials—provided within the App is the property of Futuresend App or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.
7. Termination of Use
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we determine that you have violated these Terms. Upon termination, all rights granted to you will cease and you must stop using the App.
8. Limitation of Liability
To the fullest extent permitted by law, Futuresend App, its affiliates, and its employees shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. In no event shall our total liability exceed the amount you paid for the App’s use in the past six months.
9. Dispute Resolution
Any disputes arising out of these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the designated arbitration provider. The arbitration will take place in the agreed-upon location and language.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction.
11. Links to Third-Party Sites
The App may contain links to third-party websites or services that are not operated by us. We are not responsible for the content or practices of such sites, and you use them at your own risk.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and Futuresend App regarding your use of the App, superseding any prior agreements or understandings.
